Wedding and Elopement Photography Contract Rescheduling Addendum


This addendum (“Addendum”) is entered into between (the “Client(s)”), and casey and her camera LLC d/b/a casey and her camera, an Indiana limited liability company (“Photographer”), each a “Party” and collectively the “Parties” on the date of Client(s) execution of this Addendum as indicated in the electronic signature block of this Addendum (the “Effective Date”). 

This Addendum is made and entered into to reschedule the date of performance of services under the previously executed Wedding and Elopement Photography Contract (the “Contract”), entered into by the Parties on and referenced in this Addendum. All clauses in the Contract not addressed in this Addendum remain unchanged and enforceable.

  1. Rescheduled Date. The photography coverage on the wedding day will take place on (the "Rescheduled Date"). The Client acknowledges and affirms that Photographer is entitled to rescheduling under the Rescheduling/Late Arrival and Failure to Perform clauses of the Contract. Client hereby waives any right to raise a claim against Photographer under the Contract for the rescheduling of performance of the services described in the Contract, including but not limited to the claim that they are entitled to a refund of any monies already paid to Photographer under the Contract.
  2. Retainer and Payment. The Total Investment Fee remains as selected during scheduling and specified on the Client Information Form. The Photographer will not require an additional non-refundable initial payment to reserve the Rescheduled Date. The Rescheduled Date will not be reserved until this Addendum is fully executed. Upon execution, the Photographer will reserve the services, time and date agreed upon by both parties. The Client agrees that the previously remitted non-refundable retainer was earned by the Photographer when paid, and was remitted in consideration of the experience, reputation, skill of the Photographer, and in consideration of the inability of the Photographer to schedule other clients during this time.

For events rescheduled more than 30 days in advance of the Rescheduled Date, final payment of the Investment Fee balance shall be submitted to the Photographer no less than 30 days in advance of the agreed upon Rescheduled Date. In the event the Client fails to complete final payments as designated, the Photographer shall have the right to immediately terminate all agreements with no further refund obligations. For events rescheduled less than 30 days in advance of the Rescheduled Date, all retainer and balance payments will be due in full, along with the fully executed Addendum, to confirm and finalize rescheduling.

 A late payment fee of $25/day, for up to 7 days, shall be applied to any payments made after the agreed upon date. After 7 days delinquent, the Photographer shall have the right to immediately terminate all agreements with no further refund obligations. No products shall be delivered until the entire amount is paid in full.

If complete payment of the balance owed is not received at least thirty (30) days prior to the Rescheduled Date, Photographer will be relieved of all remaining contractual obligations, and Client will be responsible for the full amount of the Addendum.

In the event the Client has submitted all retainer and balances payments prior to the execution of this Addendum, all payments are retained by the Photographer and are non-refundable. These payments, along with the fully executed Addendum, confirm and finalize rescheduling.
